This application is directed against an order dated 22.04.2024, passed by the learned District Judge, Alipore, South 24-Parganas in Misc. Appeal No.138 of 2024. The learned Judge, by the said order, was pleased to pass ad interim injunction in favour of the opposite party no.1.

Learned advocate for the petitioner submits that at present he is not making any submission on merits of the case. But however, he is making a prayer so that the appeal can be disposed of expeditiously. Upon hearing the learned advocates and considering the facts of the case, this Court is of the

view that the necessary relief can be granted to the parties if the matter is remitted back to the learned Appellant Court to consider and dispose of the Misc. Appeal No.138 of 2024 expeditiously.

This application stands disposed of with a request upon the learned District Judge, South 24Parganas, Alipore to dispose of the Misc. Appeal No. 138 of 2024 at an early date, preferably, within a period of six weeks from the next date fixed. It is, however, made clear that this Court has not gone into the merits of the case and all points are kept open for the parties to agitate before the learned Trial Court.
