2. The challenge made in this appeal is to an interlocutory order of learned Single Judge dated 13th August, 2021, passed in WPA 11764 of 2021. The main matter is pending before learned Single Judge. In the said order no final findings have been recorded which will ultimately effect the merits of the matter. The order does not fall within the ambit of 'Judgment' as per relevant clause of Letters Patent.

3. Thus, intra-court appeal is not maintainable and is, accordingly, dismissed.

4. With the dismissal of appeal, pending IA No: CAN/1/2021 is also dismissed.

5. Interlocutory order (if any) stands vacated.

6. No order as to costs.
