Earlier the writ petition was listed on 28.05.2025. Today when the writ petition has been called, none represents the petitioners.

The writ petition was preferred particularly for executing the directions passed in M.P. Case No. 70 of 2025 dated 07.02.2025 and M.P. Case No. 109 of 2025 dated 19.02.2025. Records reflect that the nature of the dispute has its genesis in a property for which the provisions of Section 163 of BNSS (Section 144 of the Code of Criminal Procedure) was invoked.

As none appears for the State, Ms. Mohuya Dutta Biswas, learned advocate, who ordinarily appears for the State, is directed to represent the State. Her appointment may be regularised by the concerned authorities.

Learned advocate for the respondent no.7 is present.

Having considered the nature of the proceedings and the prayers so advanced and the limited period for which directions are passed by

the Executive Magistrate under the relevant provisions of BNSS, I am of the view that there is hardly any scope for interference. Police authorities would on receipt of any information of dispute only exercise their powers relating to breach of the peace and maintain peace and tranquility in the area. With the aforesaid observations, the writ petition being WPA 12060 of 2025 is disposed of. There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
