The contention of the petitioners is that they are in possession of the land in question by virtue of registered deed of assignment executed by West Bengal Industrial Development Corporation Limited which has acknowledged receipt of Rs.25 lakhs from the petitioners and issued a certificate of possession to that effect. The petitioners have installed plant and machinery in the said land and have started manufacturing unit therein. It is further submitted that due to financial stringency and the prevailing pandemic, such unit is not working at

present. The petitioners have alleged that there are variations in the description of the property in question in the various deeds and instruments connected to the property which need to be addressed. The petitioners submitted a representation to that effect before the 3rd respondent on 10th January, 2020, but such representation is yet to be considered.

The petitioners pray for consideration of such representation by the 3rd respondent at the earliest.

Having considered the submissions made on behalf of the parties and material on record, I dispose of the writ petition with a direction upon the 3rd respondent to consider and dispose of the representation filed by the petitioners dated 10th January, 2020 within a period of three months from the date of communication of this order after giving reasonable opportunity of hearing to the petitioners, in accordance with law.

W.P.A. 13158 of 2021 is thus disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
