1) Affidavit-of-service filed on behalf of the petitioner is taken on record.
2) Petitioner has made an application for transfer on self medical ground on 5th August, 2021 on Utsashree portal and steps were taken by the concerned District Inspector of Schools (S.E.) on 28th September, 2021 by forwarding the same through portal to the concerned authority of West Bengal Central School Service Commission for taking final decision.
3) Present writ petition has been filed after a period of three years, that is on 30th May, 2025, seeking direction upon the concerned respondent authorities to take steps based on transfer application dated 5th
August, 2021. However, in the writ petition there is no plausible explanation of delay in approaching this Court with the present writ petition.
4) At this belated stage, this Court finds transfer application which was made on 5th August, 2021 ought not to be revived.
5) Hence, writ petition stands dismissed.
6) However, leave is granted to the petitioner to make an application for transfer in prescribed pro-forma afresh within four (4) weeks from date. If transfer application is made within the aforesaid time, same shall be considered by the concerned respondent authorities, in accordance with law, within a reasonable time thereafter.
7) Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings. (Saugata Bhattacharyya, J.)
