Heard the learned Advocates appearing for the parties. Petitioner was arrested from the place where recovery was made from a truck bearing No. JH 02 AN 5551. It is contended petitioner was not inside the truck.

Learned Advocate for the State opposes the prayer for bail.

Having considered the materials on record we note an intimate association between the petitioner and the coaccuseds in the inter State transportation of narcotic substance above commercial quantity.

Under such circumstances and bearing in mind the aforesaid materials on record and in view of statutory restrictions under Section 37 of the N. D. P. S. Act, we are not inclined to grant bail to the petitioner.

Accordingly, the prayer for bail of the petitioner is rejected.
