1) Affidavit-of-service filed on behalf of the petitioner is taken on record.

2) Petitioner made an application for transfer on general ground (distance) on 24th March, 2022 on Utsashree portal.

3) It is submitted that transfer application of the petitioner was forwarded by the school authority, where petitioner is presently working on 31st March, 2022, to the concerned District Inspector of Schools (S.E.) for taking further steps. District Inspector of Schools (S.E.) after processing the transfer application

forwarded the same to the West Bengal Central School Service Commission through portal on 5th April, 2022. 4) The grievance of the petitioner is in spite of receipt of transfer application far back on 5th April, 2022, the Commission has not decided the transfer application finally.

5) Respondents are represented by learned advocates who have jointly submitted that due to suspension of portal with effect from 29th September, 2022, contemporaneous decision could not be taken on transfer application of the petitioner.

6) On behalf of West Bengal Central School Service Commission, it is submitted that if concerned authority is directed, transfer application of the petitioner shall be decided, in accordance with law. 7) Having considered the submissions made on behalf of the parties, writ petition stands disposed of directing the Chairman, West Bengal Central School Service Commission being respondent no.4 to decide the transfer application of the petitioner by six (6) weeks from the date of communication of this order and the decision shall be communicated to the petitioner by fortnight thereafter.

8) However, it is made clear that transfer application of the petitioner shall not be rejected on the ground of suspension of portal.

9) Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings. (Saugata Bhattacharyya, J.)
