Both the petitioners and opposite party no. 2 have entered appearance through their Learned Advocates. Without delineating the factual issues, it is sufficient to record that Sessions Case No. 28/2021 pending before the Learned Judge, Fast Track, 2nd Court at Calcutta was initiated over a dispute that took place on 14th January, 2009. The case was transferred to the Learned Court of trial vide order dated 14th February, 2022 passed by the Learned Chief Judge, City Sessions Court, Calcutta.

Learned Advocate for the petitioner draws my attention to page no. 28 being an order passed upon an application under Section 438 of the Code of Criminal Procedure on 27th January, 2009 wherein the Learned Chief Judge, City Sessions Court observed that the injuries received by the petitioners were simple in nature and, therefore, the ingredient of Section 307 of the Indian Penal Code is not applicable in the instant case.

It is further submitted by the Learned Advocate for the petitioners that in the meantime, the dispute has been amicably settled between the parties. Learned Advocate for the private opposite party has seconded to it.

In view of such circumstances, the parties are directed to file joint petition of compromise in the Trial Court within seven days from the date of this order and the Trial Court shall dispose of the case on the basis of the joint petition of compromise within a fortnight. The time limit granted by this Court is peremptory.

The instant revision is disposed of with the above order.

Parties are at liberty to act upon the server copy of this order.

The petitioner is at liberty to take back the original compromise petition being CRAN/1/2022.
