Leave is granted to the petitioner to add the Secretary, Law Department, Government of West Bengal as added respondent in the course of the day.

The petitioner has filed the present writ application praying for a direction upon the respondent authorities for consideration of the representation of the petitioner for appointment of the petitioner on compassionate ground as Muslim Marriage Registrar (MMR) and Kazi in
Islampur area under Murshidabad district in place of her father.

The father of the petitioner, namely, Syed Mustak Ahmed was appointed as the Muslim Marriage Registrar (MMR) in Islampur area under Murshidabad district. The father of the petitioner while discharging his duty suffered from various ailments and accordingly is not in a position to perform his duties as Muslim Marriage Registrar (MMR) and he had made a request for appointment of his daughter as Muslim Marriage Registrar (MMR), the petitioner herein, on compassionate ground.

On receipt of the request of the petitioner as well as her father of the petitioner, the authority has taken appropriate steps for appointment of the petitioner as Muslim Marriage Registrar (MMR) and the matter is at present pending before the Law Department of Government of West Bengal.

The State has submitted a report wherein it is found that after consideration of all the factual facts, the competent authority had recommended the case of the petitioner for appointment as Muslim Marriage Registrar (MMR) in place of her father and the matter is pending before the Government for taking appropriate decision.

In view of the above, this Court finds that no purpose will be served by keeping the writ petition pending. Accordingly, the writ petition is disposed of by directing the Secretary, Law Department, Government of West Bengal to dispose of the recommendation made by the concerned authority for appointment of petitioner as Muslim Marriage Registrar (MMR) in place of her father within the jurisdiction of Islampur police station under Murshidabad district within a period of eight weeks from the date of receipt of this order.

WPA 12067 of 2025 stands disposed of.

As the writ petition is disposed of at the stage of motion and no affidavit is called for, the allegations made therein are deemed to have been denied.
10. All parties shall act on the basis of server copy of this order duly downloaded from the official website of this Court.
11. Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
