After going through the averments made in the writ petition and the reliefs claimed herein, this Court finds that the petitioner has assailed an order passed by the SubDivisional Officer, Malda annulling the patta granted in favour of the petitioner. Thus, the petitioner has challenged an order passed by an authority under the West Bengal Land Reforms Act, 1955, which is a specified Act under Section 2(r) of the West Bengal Land Reforms and Tenancy Tribunal Act, 1997.

The learned Advocate appearing for the State raises an objection as to the maintainability of this writ petition in view of the alternative efficacious remedy available under the 1997 Act.

Since there is an alternative and efficacious remedy available under the 1997 Act, this Court is not inclined to entertain this writ petition.

Faced with such situation, the learned Advocate for the petitioner prays for leave to withdraw this writ petition

with liberty to approach the appropriate forum in accordance with law.

In the light of the submission made by the learned Advocate for the petitioner, this writ petition stands dismissed as withdrawn with liberty to the petitioner to approach before the appropriate forum in accordance with law for proper reliefs on the self-same cause of action.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
