The petitioner seeks direction upon the 2nd respondent to consider and dispose of the application filed by the private respondent before the authority on 15th February, 2021 for permission to transfer the leasehold property in favour of the petitioner.

It is submitted on behalf of the petitioner that though the private respondent is agreeable to comply with the existing terms and conditions of the government and pay the necessary charges for transfer of the leasehold property in favour of the petitioner, the said application dated 15th February, 2021 has not been heeded to till date. It is submitted on behalf of the respondents that the 2nd respondent be directed to consider the application in accordance with law.

In view of the above, the writ petition is disposed of directing the 2nd respondent to consider and dispose of the application submitted by the private respondent, Subhas Chandra Poddar alias Subhash Chandra Podder dated 15th February, 2021 within a period of two months from the date of communication of this order, after giving reasonable opportunity of hearing to all the interested parties including the petitioner and the private respondent, in accordance with law.

With the above observations and directions this writ petition being WPA 11831 of 2022 is disposed of. However, there shall be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
