Affidavit of service filed in Court today is taken on record.

The petitioner has completed two years service and seeks inter district transfer from an urban area of North 24-Parganas to a rural area of Purba Medinipur. The principle ground urged is the Lung Cancer of the petitioner's mother and the paralysis of the petitioner's father. It is submitted that there is nobody else to take care of the parents of the petitioner, particularly the mother.

The petitioner claims that he has to travel 185 km one way each day to attend school from his residence. 4.

The medical condition of the parents of an Assistant Teacher is a ground for a request for transfer under Rule

8(e) of the West Bengal Primary Education (Transfer of Teachers including Head Teachers) rules of 2005, this Court requests the Secretary, West Bengal Board of Primary Education to consider the case of the petitioner sympathetically.

For the said purpose, the Chairman, DPSC North 24-Parganas shall obtain a medical opinion on the condition of the petitioner's parents from the CMOH, North 24-Parganas and forward the same to the Secretary, West Bengal Board of Primary Education.

The Secretary, West Bengal Board of Primary Education shall consider the same as requested hereinabove and pass an appropriate orders.

Let the aforesaid exercise be completed by the Chairman, North 24-Parganas and the Secretary, West Bengal Board of Primary Education within a period of twelve weeks from the date of receipt of a copy of this order along with a copy of this writ petition. 8.

With the aforesaid direction, the writ petition is disposed of.

There shall be no order as to costs.
