Affidavit-of-service filed on behalf of the petitioner is taken on record.

Learned advocate for the petitioner submits that petitioner owns a land but surprisingly private respondents are raising construction on the said land without having any right, title and interest. 3.

A Title Suit being no.183 of 2026 is filed by the petitioner wherein Civil Court passed an ad interim order of injunction directing the parties to the aforesaid suit to maintain status quo with regard to the nature, character, transfer, construction and joint possession of the suit property for a limited period. 4.

Learned advocate representing the petitioner submits that in spite of such ad interim order of injunction in violation thereto private respondents are raising construction on the land in question.

State respondents are represented by Mr. Suryaneel Das, learned Additional Government Pleader who submits that issue involved in this writ petition is civil in nature requiring the petitioner to approach appropriate forum.

In the event ad interim order of injunction passed by the Civil Court in the aforesaid suit is not complied with by the private respondents, petitioner needs to approach Civil Court in pursuit of remedy, in accordance with law.

Police authority is not the appropriate authority to decide inter se right of the parties over the land in question.

Hence, no relief can be granted to the petitioner as prayed for in this writ petition.

Writ petition stands dismissed.

10. However, this order shall not preclude the petitioner to take steps, in accordance with law.

11. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings. (SAUGATA BHATTACHARYYA, J.)
