Petitioners claim that their property is being illegally occupied by the private respondents and to that effect in case they resisted they were threatened. Inspite of informing the police authorities being the Inspector-in-Charge, Bankura Police Station on or about 29th July, 2022 no steps were taken by the police authorities.

Mr. Ansar Mondal, learned AGP appearing on behalf of the State has submitted a report. Report reflects that a long standing dispute has been existing between the parties and in order to prevent any breach of the peace, the police authorities drew up proceeding under Section 107 of the Cr.P.C.

Having considered the nature of the dispute, I am of the view that the petitioners would approach the Civil Court, if the Civil Court passes any directions upon the police authorities, police authorities would respect, obey and implement the order so passed by the Civil Court.

With the aforesaid observations WPA 12475 of 2023 is disposed of.

Report so submitted by the State be kept with record.

Copy of the reported be handed over to the learned advocate appearing for the petitioners. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
