Learned counsel appearing for the petitioners and the State respondents submit against and in favour of the impugned order respectively. According to counsel appearing for the State, the order was passed on the basis of an admission made by the petitioners before the SDO.
Without going into merits of the matter, the fact of the alleged admission does not appear from the impugned order passed by the District Magistrate. There is in fact no reason disclosed in the order for rejecting the appeal. The only fact stated is that the SDO had been satisfied of a proper procedure having
been followed by the parties and hence the order was required to be confirmed.
This Court is of the view that the impugned order suffers from a complete absence of reasons. There is no independent finding of fact or law in the said order. WPA 11842 of 2022 is accordingly allowed by setting aside the impugned order dated 31st March, 2022. The District Magistrate shall however be at liberty of considering the matter afresh upon hearing all necessary parties and passing a reasoned order within a period of three weeks from today. A copy of the reasoned order shall be made available to the petitioners within a week from the date of such reasoned order.
