Dey ... for the State The petitioners pray for a direction upon the respondent authorities for consideration of the representation filed by Surajit Bhowmik, petitioner No. 7 on 2nd August, 2021 praying for grant of pay in pay band from Rs. 5860/- to Rs. 6240/- in terms of Annexure VII of the Revision of Pay and Allowances (ROPA) Rules, 2009.

Though all the petitioners have the same prayer but the writ petition does not contain the representation on behalf of the petitioners except petitioner no. 7.

Accordingly, the instant writ petition is disposed of by directing the respondent No. 2 being the Joint Secretary, Elementary Education Branch, School Education Department to take a decision with regard

to the representation made by the petitioner No. 7 Surajit Bhowmik strictly in accordance with law, at the earliest, but positively within a period of ten weeks from the date of communication of a copy of this order.

The said respondent shall pass a reasoned order and communicate the same to the petitioner No. 7 immediately thereafter.

It is made clear that this Court has not entered into the merits of the prayer of the petitioners and all points are left open to be decided by the said respondent at the time of consideration of the representation of the petitioner No. 7.

It goes without saying that the other petitioners may file individual representation before the aforesaid respondent.

In the event, such representation is made within ten days from date the aforesaid respondent shall consider the same within a period of ten weeks from the date of receipt of the representation in accordance with the direction passed hereinabove. The writ petition stands disposed of.

Affidavit of service filed in court today is taken on record.

Urgent photostat certified copy of this order, if applied for, be given to the parties on completion of usual formalities.
