An order of the Commissioner of the School Education, West Bengal, dated February 11, 2025, is challenged in the instant writ petition.

The subject matter of the writ petition and/or the impugned order is with relation to the short-fall of the service period of the present petitioners in order to enable them to be eligible for grant of pension. The respondent/Commissioner of the School Education, West Bengal, in his order dated February 11, 2025, has recorded that the school education department is the competent authority to deal with the issues as involved in the instant writ petition. The petitioner, therefore, has prayed for relief that the matter be remanded back to the respondent no.1, the Secretary, School Education Department, West Bengal for fresh consideration of their prayer.

Keeping in mind, the attending facts and circumstances, let this writ petition be disposed of by directing the respondent no.1/the Secretary, School Education Department, Government of West Bengal, to treat the instant writ petition as the application filed by the petitioners before the said office and consider and dispose of the same in the light of the settled law. In the process, the said respondent shall afford a reasonable opportunity of hearing to the present petitioners and any other person/authority as he may deem fit and proper. The said respondent shall pass a reasoned order, in the light of the judgment as enclosed along with the present writ petition. Let the entire exercise as above, be concluded by the respondent no.1, within a period of four weeks from the date of communication of copy of this order as well as copies of the writ petition along with all its annexures and the supplementary affidavit.

Urgent certified copy of the order, if applied for, shall be given to the parties, as expeditiously as possible upon compliance of all necessary formalities. (Rai Chattopadhyay, J.)
