The learned advocate appearing for the petitioner submits that M. Case No. 636 of 2018 was initiated five years ago and till date, the same is pending. The petitioner submits that the petitioner is without any effective remedy and has to attend the court at regular intervals. The petitioner submits that the learned Additional Chief Judicial Magistrate, Barasat on 03.01.2019 was pleased to award interim maintenance of Rs.4000/- per month for herself and Rs.3000/- per moth for her minor son, aggregating to a sum of Rs.7000/- per month. It has also been submitted that the said amount is not commensurate with the earnings of the husband/opposite party no.1.

Having regard to the anxiety expressed by the learned advocate appearing for the petitioner that the trial of the case is continuing for about five years, I direct the learned Additional Chief Judicial Magistrate, Barasat to fix at least one date in every 45 days so that trial of the case can be taken to its logical conclusion. No unnecessary adjournment should be granted to either of the parties and cost be

imposed, if any attempt is made for delaying the trial of the case.

With the aforesaid observations, the revisional application being CRR 1908 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
