Learned advocate for the petitioner submits that the petitioner is in possession of the immovable property. The petitioner is not aware of any proceeding under the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002. Once the details are provided, the petitioner can approach the Debt Recovery Tribunal under the Act of 2002.

The e-auction sale notice annexed to the writ petition itself shows that the Bagmari Branch of UCO Bank is proceeding with the sale. The petitioner is, therefore, not remediless for seeking particulars from UCO Bank, Bagmari Branch, if required. There are statutory, alternative remedies available to the petitioner under the Act of 2002.

Interference by a Writ Court is not called for. WPA 13080 of 2021 is disposed of accordingly.
