(DB) 2022 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Kaliachak Police Station Case No. 399 of 2022 dated 16.04.2022 under Section 506 of the Indian Penal Code read with Sections 4/6 of the POCSO Act.

And In Re : Barik Sk. @ Kayesuddin Sk. ..... petitioner Mr. Kalidas Saha ... for the petitioner Mr. S. S. Imam Mr. S. Kundu ... for the State Statement of the victim girl recorded under Section 164 of the Code of Criminal Procedure shows that the petitioner had subjected her to penetrative sexual assault.

In view of the aforesaid incriminating materials on record and prima facie involvement of the petitioner therein, we are not inclined to grant bail to the petitioner.
