The subject matter of challenge in this revisional application is the order dated 23.07.2021 passed by learned Judge, Debts Recovery Tribunal III, Kolkata in S.A. No. 453 of 2015. The revisional jurisdiction of this Court has been approached for the non-functioning of Debts Recovery Appellate Tribunal at the relevant point of time.

In view of the submission disclosed by both the parties, it appears that the Debts Recovery Appellate Tribunal has resumed its ordinary function.

That being the position, it is better for this Court not to pursue the matter any more.

On the prayer of learned advocate for the petitioner, the matter stands dismissed as not pressed.

Petitioner is given liberty to approach the learned Debts Recovery Appellate Tribunal within a fortnight from hence, taking advantage of this order. The limitation, if there be any, should not be taken to be a bar in approaching the Debts Recovery Appellate Tribunal.
