Mr. Ratul Biswas, learned Counsel for the petitioner submits that the petitioner intends to file a fresh writ petition challenging the constitutional validity of Section 10C of the West Bengal School Service Commission Act, 1997, as such he is not willing to press this application.

The written instruction of the petitioner addressed to his advocate-on-record be kept with the record. In view of the aforesaid stand of the petitioner W.P.A. 12491 of 2023 is dismissed as not pressed without any order as to costs.

This order, however, will not prevent the petitioner to file a fresh writ petition to throw a challenge to the aforementioned provision of the said Act of 1997, in the manner indicated above.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
