Learned counsel for the petitioners submits that they are not principal assailants and they claim parity with coaccused Rebati Ranjan Ghosh who has been granted bail by this Court earlier.

Learned counsels for the State and defacto complainant oppose the prayer.

I have considered the material on record. The husband of the 1st petitioner appears to be the principal assailant. Though the 1st petitioner has been named by a witness in his statement recorded under Section 164 of the Code of

Criminal Procedure, not much role has been attributed to her. The 2nd petitioner has not been named.

Considering the material available on record and extent of complicity of the petitioners in the alleged offence, prayer for bail of the petitioners is allowed. The petitioners (1) Kakali Chatterjee and (2) Soma Sarkar, be released on bail upon furnishing bond of Rs.10,000/- (Rupees Ten Thousand only) each, with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Additional Chief Judicial Magistrate, Chandannagar, Hooghly.

The application for bail is, thus, disposed of. Case Diary be returned.
