Mr. Shounak Mondal ...for the Petitioners Mr. Rajen Banerjee Mr. Bankim Pal ...for the State

1. Learned Advocate appearing for the petitioners submits that the alleged recovery in the present case is 985 gms of brown sugar. The petitioners are in custody for more than eight months and the prosecution has submitted chargesheet wherein they have relied upon six witnesses.

2. Learned Advocate appearing for the State opposes the prayer for bail and submits that it is from the possession of these petitioners that the recovery of the contraband has been made. Attention of the Court was also drawn to the chemical examiner's report and the same do not enure any benefit to the present petitioners.

3. Learned Advocate for the petitioners emphasize that the present petitioners are ladies. Having regard to the same I direct that at this stage petitioners are unable to overcome the rigors of Section 37 of the N.D.P.S Act. Petitioners would renew their prayer for bail after the evidence of the seizure list witnesses are over.

4. Learned Trial Court would within a period of three months from the date of consideration of charges give priority to the evidence of seizure list witnesses.

5. However, at this stage as observed prayer for bail in CRM (NDPS) 1252 of 2026 is rejected.

6. Memo of evidence submitted be kept with the record.

7. All parties shall act in terms of server copy of the order downloaded from the Official website of this Court.

8. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
