Heard learned Advocates appearing for the parties. Pursuant to the earlier order of this court dated 20th June, 2023, Mr. Dudhoria, learned Advocate appearing for the respondents files a written instruction to show that the grievance of the petitioners has been redressed after the order of this court by passing an order of refund amounting to Rs.25,11,770 manually, on 22nd June, 2023, by an order under Section 154 of the Income Tax Act, 1961 as per order under Section 5(2) of Vivad se Vishwas Act, 2020. Such written instruction of DCIT, Circle13(1), Kolkata filed through the learned Advocate appearing for the respondents be kept with the record. The aforesaid Assessing Officer is present in court and submits through his learned Advocate that manual payment will take some time.

Considering such submission of the aforesaid Assessing Officer, this writ petition being WPA 12496

of 2023, is disposed of by directing the Assessing Officer concerned to make the payment manually as per his aforesaid order dated 22nd June, 2023 positively within a month from the date of communication of this order.

Liberty is granted to the petitioners to make any claim of statutory interest, if it is entitled under the law, before the authority concerned.
