01.9.2021 WPLRT 42 of 2017 with CAN 1 of 2021 Ct-16 Tarapada Das & Ors.

Vs.

The State of West Bengal & Ors.

ar The writ petitioners are not represented.

Mr.

Tapan Kumar Mukherjee, learned Additional Government Pleader, who usually represents the State of West Bengal, is requested to appear in this matter. Let the appointment of Mr. Mukherjee along with a junior of his choice be regularised.

The writ petition is directed against an order dated September 22, 2016 passed by the learned 4th Bench, West Bengal Land Reforms and Tenancy Tribunal by virtue of which the original application was disposed of upon recording that the plot information, as sought for by the original applicants, has been supplied, as would be evident from the status report submitted by the Block Land and Land Reforms Officer, Sonarpur. It appears from the original application that the writ petitioners also prayed for mutating their names in the L.R record of rights in respect of the lands in question. However, no decision has been taken by the learned Tribunal in this regard.

The persons in whose name the plots have been recorded in the record of rights as evident from the plot information have also not been impleaded in the original application and also in the instant writ petition.

WPLRT 42 of 2017 is disposed of by directing the Block Land and Land Reforms Officer, Sonarpur to consider the representation dated

14.03.2013 insofar as it relates to the prayer for mutating the names of the writ petitioners in respect of the plot in question and dispose of the same by passing a reasoned order after giving an opportunity of hearing to the writ petitioners as well as the other interested persons within a period of twelve weeks from the date of communication of this order.

The said authority shall communicate the reasoned order to the parties within two weeks thereafter.

Since the writ petitioners are unrepresented, the department is directed to communicate this order to the petitioners within one week from date by speed post with acknowledgment due.

In view of disposal of the writ petition, the application being CAN 1 of 2021 has become infructuous and the same also stands disposed of.

Urgent photostat copy of this order, if applied for, be given to the parties upon compliance of all formalities.
