The father of the petitioner was an Assistant Teacher at Murah Kata Primary School, a school under Narayangarh East Circle of Paschim Medinipur District Primary School Council and he had died-in-harness on February 24, 2020.

The Council could not consider the prayer of the petitioner for compassionate appointment as the pension payment order in favour of the mother of the petitioner for family pension was not issued.

Mr. Shahi, learned AGP files the report as directed by the order dated November 13, 2024; let it be kept with the record. It appears from the said report that pension payment order has been issued in favour of the mother of the petitioner. In view of such development, there is no difficulty now to consider the prayer of the petitioner for compassionate appointment.

Accordingly, the Chairman of the Council being the respondent no.3 is directed to consider the said prayer in accordance with law and in the event, it is found that the petitioner is entitled to such appointment, shall take forward steps. WPA 13600 of 2024 is disposed of with the above terms without any order as to costs.
