1. This Court has heard learned Advocate for the petitioner and the learned Advocate for the State at length.
2. On careful perusal of the entire materials as placed before this Court including the materials available in the case diary, it reveals that admittedly the present accused petitioner is not named in the FIR. Materials have been placed before this Court that the present accused petitioner is languishing in judicial custody for a considerable length of time.
3. However, considering the materials as collected by the Investigating Officer in course of investigation it appears to this Court that sufficient materials have been placed before this Court that there is every reason to believe that the present accused
petitioner is one of the key persons of the alleged crime and there is every apprehension that in the event the present accused petitioner is enlarged on bail, he may abscond and/or tamper with the evidence.
4. This Court considers that this is a fit case for custodial trial.
5. The application for bail is thus considered and rejected. (Partha Sarathi Sen, J.)
