Heard learned counsels for the parties.

The petitioner claims to be the Director of M/s Tao Power Private Limited, a leading manufacturer of erickshaw in the State of Bihar and Jharkhand. ICAT certificate was issued in favour of the petitioner in terms of the Rule 126 of the Central Motor Vehicles Rule, 1989 with regard to launching of e-rickshaw, on 16th February, 2018. The petitioner seeks liberty to submit an application before the Director, Transport Directorate, being the 2nd respondent herein to forward the said certificate to all the RTOs and ARTOs in the State of West Bengal.

It is submitted on behalf of the respondents that the 2nd respondent be directed to consider the application in accordance with law.

In view of the above, the writ petition is disposed of with liberty to the petitioner to submit the application as sought before the 2nd respondent within 7 days from date. The 2nd respondent is directed to consider and dispose of the application within one month from the date of receipt thereof upon affording reasonable opportunity of hearing to all the interested persons including the petitioner, in accordance with law. The writ petition is thus disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
