03.03.2025 tkm/ct 28 C.R.M. (DB) 1561 of 2024 sl no.83 In Re : An application for cancellation of bail under section 439(2) of Cr.P.C And In Re : Mofarjel Hossain ....... petitioner Mr. Kamalesh Ch Saha Ms Payel Mitra Mr. M Saha Mr. S Saha ...for the petitioner Ms. Debolina Das ...for the State
1. Learned lawyer challenges the order granting anticipatory bail on the ground that the learned judge had not considered the injury report and opposite party after grant of bail is threatening witnesses. The first ground is unfounded. Perusal of the order shows learned judge looked into the case diary including the injury report and came to a finding that custodial interrogation is not necessary. On the second issue with regard to misuse of liberty we find that the allegation of misuse of liberty is extremely vague and bereft of material particulars.
2. Hence, we do not wish to interfere with the order granting bail to opposite party.
3. Application for cancellation of bail is disposed of. (Gaurang Kanth, J.) (Joymalya Bagchi, J.)
