Seven students of Ambika Devi Primary Teachers Training Institute (hereinafter referred to as 'the Institute') have approached this Court by filing the present writ petition, seeking a directive to the concerned respondent to allow their registration as students for the academic session 2024-2026.
Mr. Jana submits that the Institute initiated the Diploma in Elementary Education (D.El.Ed) course with an intake capacity of fifty students. Initially, fifty students were admitted in accordance with the prescribed procedure. However, seven students subsequently discontinued their studies and left the Institute. To fill the vacancies arising from their discontinuation, the Institute admitted the
present petitioners in October 2024 from the approved merit list He further submits that since their admission, the petitioners have been attending classes regularly. In an effort to complete the registration process, the petitioners approached the Institute, which thereafter submitted an application to the West Bengal Board of Primary Education for the registration of the petitioners. However, despite receiving the said application from the Institute, the Board has not completed the registration process to date. This inaction on the part of the Board has compelled the petitioners to approach this Hon'ble Court by filing the present writ petition.
Mr. Jana submits that an appropriate direction be issued to the Board to expeditiously complete the registration process of the petitioners as students of the Institute.
Mr. Biswas, learned advocate appearing on behalf of the Board, opposes the petitioners' contention and submits that it is unclear to the Board whether the present petitioners were admitted to the Institute in accordance with the prescribed procedure and within the stipulated time frame. However, he submits that if the matter is referred to the appropriate authority for
consideration and decision, he will not oppose such course of action Heard the learned Advocates appearing for the respective parties and perused the material on record.
It is an admitted fact that fifty students were initially admitted to pursue the D.El.Ed course.
Subsequently, seven students discontinued their studies and left the Institution. The vacancies created by the discontinuation of these seven students were filled in accordance with the merit list, and consequently, the present petitioners were admitted in October 2024. Since their admission, the petitioners have been regularly attending classes.
To regularize their admission, the registration process needs to be completed. The Institute submitted an application to the Secretary of the Board for this purpose. However, despite receipt of the application, no further action has been taken.
Taking note of the foregoing facts, this writ petition is disposed of with a direction to the Secretary, West Bengal Board of Primary Education, to decide on the application submitted by the Institute on 24th April 2024, after affording an opportunity of hearing to the Institute. If the Secretary finds the contentions
raised by the Institute to be justified, necessary follow-up actions shall be taken, which may include the completion of the registration process for the present petitioners. However, if the Secretary concludes that the petitioners' contentions lack merit, a reasoned order shall be passed and communicated to the Institute and the petitioners.
The entire exercise shall be completed within a period of four weeks from the date of communication of this order.
There shall, however, be no order as to costs.
