1. Heard learned Counsel for the parties.
2. No doubt, the trial has been prolonged in the present case but by now, all the witnesses have been examined and statement of the petitioner under Section 313 Cr.P.C. has already been recorded. When the matter was posted for hearing of argument, the prosecution has filed a petition to recall two medical officers for exhibiting the FSL report. At this juncture, the application for bail has been filed.
3. Regard being had to such facts and submissions, we are not inclined to exercise discretion under Section 439 Cr.P.C. in favour of the petitioner at this stage. However, the learned Trial Court is directed to conclude the trial and deliver the judgment in this case within a period of 60 days from the date of communication of this order.
4. Department is directed to communicate this order forthwith.
5. Accordingly, the prayer for bail is rejected.
