1) It is submitted on behalf of the defendants /petitioners that the defendants'/petitioners' application under Order 7 Rule 11 of the Code of Civil Procedure has not yet been disposed of by the Trial Court though the plaintiffs/opposite parties before the learned trial court have already filed the written objection.
2) It is further submitted that from the certified copy of the orders as have been annexed to the instant petition it would reveal that the next date in the said suit is fixed on 24.06.2025 but the learned Trial Court for the reasons best known to him has not fixed any date for hearing of the petition under Order 7 Rule 11 as filed by the defendants/petitioners.
2) In view of such, this Court while disposing of the instant revisional application directs the
learned trial court to dispose of the defendants'/petitioners' application under Order 7 Rule 11 of the Code of Civil Procedure positively by the last date of July 2025 after giving due opportunity of hearing both to the plaintiffs and defendants. The time limit as fixed by this Court is mandatory and peremptory.
3) Liberty is given to the learned advocate on record for the defendants/petitioners to communicate the server copy of this order to the learned Trial Court.
4) Learned Trial Court is hereby directed to act on the server copy of this order.
5) With the aforementioned observation the instant revisional application is disposed of. (Partha Sarathi Sen, J.)
