1. Report submitted by the NCB be kept with the record.

2. Learned senior advocate appearing for the petitioner submits that the petitioner is in custody for 414 days and the petitioner has been arrested on the accusation of having recovered 6363 bottles of Codeine Phosphate/Phensedyl/Eskuf cough syrup(s). Till date, only one witness has been examined and the prosecution has relied upon nine (09) witnesses in order to prove its case.

3. Learned advocate appearing for the NCB submits that efforts have been made to proceed with the trial, however, for other reasons, the trial could not proceed for which the prosecution cannot be held responsible.

4. Be that as it may, the learned Trial Court, within a period of six months, would conclude the examination of seizure-list witnesses, be it independent or associated with the complainant authority.

5. Petitioner would be at liberty to approach this Court with a prayer for renewal after the time period is over.

6. At this stage, the prayer for bail of the petitioner is rejected, however, the learned Trial Court would adhere to the time schedule as quoted above.

7. Accordingly, CRM (NDPS) 1302 of 2026 is dismissed.

8. All parties shall act in terms of the server copy of the order downloaded from the official website of this Court.

9. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
