This is an application for anticipatory bail filed in connection with Kaliganj Police Station Case No.425 of 2025 dated 15.05.2025 under Sections 109/115(2)/117(2)/126(2)/303(2)/351(2)/3(5) of the Bharatiya Nyaya Sanhita, 2023.

Heard the learned Advocate for the petitioners as well as the learned Additional Public Prosecutor.

Having considered the submissions of the learned Advocates for the parties and also considering the materials on record, this Court is of the view that the petitioners as well as the de-facto complainant entered into a brawl which resulted in inflicting injuries on both the parties. Hence, custodial interrogation of the petitioners is not necessary and they may be granted anticipatory bail however, subject to conditions. 4.
Accordingly, it is directed that in the event of arrest, the petitioners, namely, (1) Tukarjuban Sk. @ Tukar Juban Sekh, (2) Saharul Sk. & (3) Malek Chand Sk., be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten thousand only) each, with
two sureties of like amount each, one of whom must be local, to the satisfaction of the arresting officer and also subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 and on further condition that the petitioners shall cooperate with investigation and shall not intimidate witnesses or tamper with evidence in any manner whatsoever. They shall meet the Officer-in-charge of the concerned police station once in a month until further orders.
