Vishal Kumar ... for the State-respondent(s) Learned advocate for the petitioner submits that the petitioner is in custody for two years and has been implicated in the instant case for alleged recovery of 395 gm of brown sugar from his house. According to the learned advocate, the petitioner is unnecessarily detained in custody and he may be released on bail.

Learned advocate for the State opposes the prayer for bail and submits that out of 9 witnesses cited by the prosecution, seven witnesses have already been examined. Having considered the advanced stage of the case, I am of the opinion that, at this stage, it would not be fit and proper to release the petitioner on bail and the prosecution must be granted an opportunity.

Hence, the prayer for bail of the petitioner is Rejected.

However, if the prosecution is unable to complete rest of the witnesses within a period of six months, the learned trial court would, after the aforesaid period is over, release the petitioner on bail.

With the aforesaid directions, CRM (NDPS) 1282 of 2026 is disposed of.
