Earlier the writ petition was listed on 05.06.2025. Today when the writ petition has been called, none represents the petitioner.

Learned advocates for the State and the private respondent nos. 9 to 13 are present.

Report submitted by the learned advocate appearing for the State be kept with the record. The petitioner has approached this Court praying for reinstatement of peace and tranquility as also to be protected from the overt acts of the private respondents. Petitioner also complains that he and his family members are unable to enter the village.

Learned advocate appearing for the private respondent nos. 9 to 13 submits that the issue has been settled by an order dated 27.12.2023 passed by a coordinate Bench of this Hon'ble Court in WPA 11715 of 2023.

I have taken into account the report submitted on behalf of the State as well as the communication made to the SDPO, Arambagh

which reflects of illegal construction being resisted by the petitioner. Having regard to the nature of the dispute complained of and the steps taken by the police authorities, I am of the view that no further interference is required except to the extent that the police authorities would ensure that no untoward incident results because of the inimical relationship existing between the petitioner and the private respondents and the situation is not blown out of proportion.

With the aforesaid observations, the writ petition being WPA 12145 of 2025 is disposed of. There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
