Report submitted by the State is taken on record. Heard learned counsels for the parties.

The petitioner approached the Hon'ble Supreme Court seeking bail which was turned down by the Hon'ble Supreme Court on 16th July, 2024 with a direction upon the learned trial Court to expedite the trial under Section 309 of the Code of Criminal Procedure. Despite such direction, this Court is informed that witness action has not commenced as yet and 34 witnesses are proposed to be examined. Learned counsel for the State opposes the prayer and submits that three of the accused are still absconding for which trial has not been proceeded with.

In view of the incriminating material against the petitioner which was considered by the Hon'ble Supreme

Court in rejecting the prayer for bail, prayer for bail is rejected at this stage.

The learned trial Court is directed to split up the trial and take all possible steps for expeditious disposal of the case without granting any unnecessary adjournment to either of the parties, in compliance with the direction of the Hon'ble Supreme Court.

The application for bail is thus disposed of. Case diary be returned.
