The petitioner is in custody for more than one year. Learned counsel for the petitioner submits that the evidence of two eye witnesses to the alleged incident is contradictory. There is no other eye witness to the incident. Only nine out of twenty-five witnesses have been examined. The petitioner prays for bail. Learned counsel for the State opposes the prayer. I have considered the material on record.

The petitioner absconded for about three years before he was arrested. Nine out of twenty-five witnesses have been examined. The quality of evidence of the witnesses shall be assessed at the appropriate stage of trial.

Considering the material on record, gravity of the offence and prima facie involvement of the petitioner therein, prayer for bail is rejected at this stage.

The learned trial Court is directed to expedite the trial without granting any unnecessary adjournment to either of the parties. The application for bail is disposed of.
