The petitioner is in custody for more than eight months and prays for bail.

Learned counsel for the petitioner submits that the co-accused, Samsul Seikh @ Suman Kaka @ Hatkupa, similarly circumstanced with the petitioner, has been granted bail earlier. The petitioner has no nexus with the alleged offence.

Learned counsel for the State opposes the prayer. I have considered the material on record. The mobile phone of the deceased and an old iron made sharp cutting knife were recovered from the petitioner pursuant to his leading statement. Considering the gravity of the offence and prima facie involvement of the petitioner therein, the prayer for bail is rejected at this stage.
