Petitioner complains that he intends to repair the property being a shop room which is situated at his own land and is being obstructed by unknown miscreants. To that effect, information was furnished to the police authorities and the petitioner also approached the learned Executive Magistrate under Section 163(2) of the BNS.

Police has submitted a report complaining that there is a long standing land dispute between the petitioner and the private respondents. The private respondents claimed that the land is an unpartitioned land. However, the police authorities have drawn up proceedings under Section 126 of the BNSS for maintaining peace and tranquility in the area.

Having considered that the proceedings have been drawn up, police authorities would continue their surveillance and ensure only to the extent that no untoward incident results because of the inimical relationship existing between the parties.

With the aforesaid observations, WPA 12147 of 2025 is disposed of.

There will be no order as to costs.

Report submitted by the learned advocate appearing for the State be kept with the record. A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
