Mr. Kishore Mukherjee, Mr. Ahitagni Dey ...for the petitioner Learned counsel appearing for the petitioner contends that despite there being several irregularities in the reappointment of respondent no. 4 as Nayeb Kazi in respect of Khargram, District-Murshidabad, the respondent no. 3, that is, the District Registrar, Murshidabad, sat tight over the representation given by the petitioner in that regard (Annexure P/6 at page 34 of the writ petition).

Since none appears for the respondents, the matter is taken up for ex parte hearing.

In view of the innocuous nature of the order proposed to be passed, further service of notice on the respondents is not being directed.

W.P.A. No. 9741 of 2016 is disposed of by directing the respondent no. 3 herein, that is, the

District Registrar, Murshidabad, to consider and decide on the representation of the petitioner, annexed as Annexure P/6 at page 34 of the writ petition, on its merits in accordance with law, upon giving opportunity of hearing to the petitioner as well as to respondent no. 4 and all concerned, as expeditiously as possible, positively within eight weeks from the date of communication of this order to the respondent no. 3.

The petitioner shall communicate this order, accompanied by a server copy of this order, to the respondent no. 3 for ensuring compliance of the same.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance of all necessary formalities.
