Learned advocate appearing on behalf of the petitioner submits that he has come before this court against the impugned order dated 30.04.2018 passed by the learned Additional District and Sessions Judge, 2nd Court, Malda (learned Judge, Special Court, NDPS Act, Malda) thereby refuses the prayer for discharge of the petitioner from the instant case. Trial has already been commenced and some of the witnesses have been examined.

In view of the above status of the proceedings, the present petitioner does not want to proceed with the case and prays for withdrawal of the instant case.

Under the above facts and circumstances, there is no impediment to allow such prayer.

Accordingly, CRR 1800 of 2018 is dismissed as withdrawn.

Interim order, if any, stands vacated.

Let a copy of this order be communicated to the learned court below immediately.

Liberty is granted to all parties to act in terms of the copy of this order downloaded from the official website of this court.
