1. After hearing the learned Counsel for the parties, we dispose of the appeal by directing the Chairman, D.P.S.C., North 24-Parganas to consider the claim of widow pension.

2. The school authorities are directed to produce all relevant record in relation to the date of superannuation, leave, option and length of service and any other details required for the purpose considering the claim of widow pension by the Chairman, D.P.S.C., North 24-Parganas.

3. We direct the Chairman, D.P.S.C., North 24-Parganas to decide the issue after giving an opportunity of hearing to the school and the appellant and pass a reasoned order within a period of eight

weeks from the date of communication of this order.

4. The reasoned order shall be communicated to the writ petitioner within a week from the date of order being passed in terms of this order.

5. The order impugned is hereby set aside.

6. The appeal succeeds.

7. We request Mr. Pinaki Dhole, learned Counsel appearing on behalf of the State to communicate this order to the Chairman, D.P.S.C., North 24-Parganas and the Head Teacher, Paschim Chowberia F.P.S. School for information and compliance.

8. The appeal and the application, accordingly, stand disposed of.

9. However, there shall be no order as to costs.
