This is an application for expeditious hearing of the application under Section 7(2) of the West Bengal Premises Tenancy Act, 1997 (hereinafter referred to as "the said Act").

Record reveals that April 23, 2021 was fixed for evidence in connection with the said petition. The learned advocate for the petitioner submits that though dates were fixed for evidence in connection with the said petition but no evidence was taken on April 23, 2021. He submits that the next date is fixed on October 1,2021. In view of the order sought and proposed to be passed, there is no necessity of issuing notice upon the opposite parties. However, the petitioner shall be obliged to forward a copy of this application as well as this order upon the opposite parties or their learned advocate in the Court below forthwith.

CO 1458 of 2021 is disposed of by requesting the learned Judge, 3rd Bench, Presidency Small Causes Court at Calcutta to take up the evidence in connection with the petition under Section 7 (2) of the said Act on the next

date fixed i.e. on October 1,2021 and to make endeavour to dispose of the same as expeditiously as possible without granting any unnecessary adjournments to either of the parties.

Urgent Photostat certified copy of this order, if applied for, be given to the learned advocate for the parties on usual undertakings.
