Mr. Shahan Shah ... ... for the petitioners Mr. Lalit Mohan Mahato Mr. Sayan Ganguly ... ... for the State The petitioners have come up with the grievance that in the list of beneficiaries of Pradhan Mantri Awas Yajona, annexure P-1, names of the persons have been included who are not eligible and who are having even two-storied pacca houses. He submits that the names of ineligible persons should be excluded from the list. Learned counsel for the State has pointed out that the list, annexure-P-1, is only a provisional list wherein the objections have been invited and the list has been sent to the Block Development Officer for finalization. If that is so, then the respondent no.3, Block Development Officer can duly consider the grievance raised by the petitioners in respect of exclusion of names of ineligible persons from the list.

Hence, we dispose of this writ petition granting liberty to the petitioners to file a detailed representation before the respondent no.3 disclosing the names of ineligible persons whose homes have been included in the list, annexure P-1, and on receipt of such a representation the respondent no.3 will make due enquiry and take a decision in accordance with law.

The petitioners are permitted to file their representation within a period of two weeks from today. Let this exercise be completed by respondent no.3 within a period of two months from the date of receipt of a copy of this order.
