This is an application for anticipatory bail filed in connection with NDPS Case No.110 of 2022 arising out of Bongaon P.S. Case No.825 of 2022 dated 06.08.2022 under Sections 21(c)/27A/29 of NDPS Act.

The prayer for anticipatory bail of the petitioner was rejected earlier on 2nd May, 2023.

3. The learned advocate representing the State has opposed the grant of anticipatory bail.

Reasonable grounds with regard to criminality of the petitioner to have not been engaged in the offence alleged did not satisfy the conscience of this Court. The petitioner could not go beyond the embargo of Section 37 of the NDPS Act. Moreover the charge-sheet

has already been submitted establishing prima facie case against the petitioner.

5. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
