1. This Court has heard learned Advocate for the petitioners and the learned Advocate for the State at length.

2. On careful consideration of the entire materials as placed before this Court including the materials available in the case diary, it appears to this Court that the present two accused petitioners are not the principal assailants.

3. Admittedly, there are some incriminating materials as against the present two accused petitioners. However, those are not sufficient for taking contrary view while disposing the instant application for bail.

4. Accordingly, the prayer for bail of the present accused petitioners is allowed.

5. Accordingly, it is ordered that the petitioners, namely, Joydeb @

Jaydeb Biswas and Gayanath @ Gaya Biswas, be released on bail upon furnishing a bond of Rs. 5,000/- (Rupees five thousand), with two registered sureties of like amount each, to the satisfaction of the learned Additional Chief Judicial Magistrate, Kalyani, Nadia and also on further direction that the present accused petitioners shall meet the Investigating Officer of this case as and when call for till submission of the final report.
