This is an application for anticipatory bail filed in connection with Ghola P.S. Case No.189 of 2025 dated 19.05.2025 under Sections 137(2)/140(3) of the Bharatiya Nyaya Sanhita, 2023. 2.

Heard the submissions of the learned advocate representing the petitioners as well as the State.

The materials on record as well as the complaint lodged by the landlord dated 23rd May, 2025 along with the statements recorded under Section 180 of BNS revealed the victim to board a white coloured vehicle along with her father.

The learned advocate representing the petitioner submitted that the petitioner had been falsely implicated in the instant case on the ground of his prior rivalry with the police authorities.

5. The learned advocate representing the State submitted that the petitioner did not comply with the notice served under Section 179 of BNSS.

The disparity in the version recorded in the case diary demands grant of anticipatory bail in favour of the petitioner. 7.

Accordingly, it is directed that in the event of arrest, the petitioner, namely, Raja Kumar Shaw be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten thousand only), with two sureties of like amount each, one of whom must be local, to the satisfaction of the arresting officer and also subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 and on further condition that the petitioner shall cooperate with investigation and shall not intimidate witnesses or tamper with evidence in any manner whatsoever. The petitioner shall meet the Officer-in-Charge of the concerned police station once in a fortnight until further orders.
