As none appears on behalf of the State, Ms. Debjani Sahu, learned advocate, is directed to appear and represent on behalf of the State in this matter. Her appointment may be regularised by the concerned authorities.
The present revisional application was preferred challenging the proceedings arising out of Bhabanipur Police Station Case No.45 of 2002 under Sections 323/308/34 of the Indian Penal Code.
Records of the revisional application reflect that although the revisional application is pending for more than nine years, but till date the revisional application has not been admitted. Having regard to the same and the contents which have been canvassed in the revisional application, I am of the view that the same are questions of fact and are to be dealt with by the learned trial curt at the relevant stage. As such, no interference is required.
Accordingly, CRR 1817 of 2012 is dismissed.
Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.
